1. Acceptance of Terms

By accessing, browsing, or using CB Monitor ("the Service", "we", "us", "our") available at cbmonitor.net, you ("User", "you", "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease all use of the Service.

These Terms constitute a legally binding agreement between you and CB Monitor. We reserve the right to modify these Terms at any time. Changes become effective upon posting to this page. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Age Requirement and Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to access or use this Service. By using the Service, you represent and warrant that you meet this age requirement.

We reserve the right to request proof of age at any time and to suspend or terminate accounts where there is reasonable doubt about the user's age. If we discover that a user is under the minimum age requirement, we will immediately terminate their account and delete all associated data.

You must have the legal capacity to enter into binding agreements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Service

CB Monitor is an analytics and data aggregation platform that collects, processes, and displays publicly available information from third-party adult live streaming platforms, specifically Chaturbate. The Service provides:

  • Real-time monitoring of publicly accessible chat rooms, including chat messages, viewer counts, and tipping activity
  • Historical data analytics including earnings trends, user behavior patterns, and session statistics
  • User tracking and cross-model audience analysis based on publicly visible activity
  • Session recording and playback features (available to Pro subscribers)
  • Data export capabilities for analytical purposes

The Service operates by collecting data that is publicly visible to any visitor of the third-party platforms. We do not bypass any access controls, authentication systems, or privacy settings implemented by these platforms.

4. No Affiliation Disclaimer

CB Monitor is an independent, third-party service. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to Chaturbate, Multi Media LLC, or any of their subsidiaries or affiliates. All product names, trademarks, and registered trademarks are the property of their respective owners.

The use of any third-party trademarks on this Service is for identification and reference purposes only and does not imply any endorsement, affiliation, or sponsorship.

5. Content and Data Disclaimer

CB Monitor does not create, host, distribute, produce, store, or control any adult content. The Service aggregates publicly available metadata including:

  • Text-based chat messages visible in public chat rooms
  • Usernames and publicly displayed user information
  • Tipping amounts and token transactions that are publicly broadcast
  • Viewer counts and room status information available through public APIs

Live video streams displayed within the Service are embedded directly from the original third-party platform using their publicly available HLS streaming URLs. These streams are not copied, stored for redistribution, modified, or re-hosted by CB Monitor.

Session recordings, where available to Pro subscribers, are screen captures of publicly available broadcasts created for analytical and personal review purposes. These recordings are access-controlled, protected against unauthorized distribution, and are automatically deleted after 30 days.

We make no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any data displayed on the Service. Data may be delayed, incomplete, or contain errors due to the nature of real-time data collection from third-party sources.

6. User Accounts

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept all responsibility for all activity that occurs under your account
  • Immediately notify us of any unauthorized use of your account

You may not create multiple accounts, share your account with others, or transfer your account to another person. We reserve the right to suspend or terminate accounts that violate these Terms.

7. Subscription Plans and Payments

The Service offers free and paid subscription tiers (Premium at $9.99/month and Pro at $19.99/month). By subscribing to a paid plan, you agree to the following:

  • Billing: Subscriptions are billed on a monthly recurring basis through our third-party payment processors (currently PayPal and/or Stripe). You authorize us to charge your selected payment method on a recurring basis.
  • Pricing: We reserve the right to change subscription prices at any time. Price changes will be communicated to existing subscribers at least 30 days in advance and will take effect at the start of the next billing cycle.
  • Cancellation: You may cancel your subscription at any time through your payment provider's management portal or by contacting us. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your paid period.
  • Refunds: We generally do not offer refunds for partial subscription periods. However, we may consider refund requests on a case-by-case basis for documented service issues. Refund requests must be submitted within 7 days of the charge.
  • Free trials: If we offer a free trial, you may be required to provide payment information. If you do not cancel before the trial ends, you will be automatically charged for the subscription.
8. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You specifically agree not to:

  • Use the Service for any purpose that is illegal or prohibited by these Terms
  • Attempt to download, copy, redistribute, share, or commercially exploit any recordings, data, or content from the Service
  • Circumvent, disable, or interfere with any security features, digital rights management systems, access controls, or content protection measures
  • Use automated systems, bots, scrapers, crawlers, or similar tools to extract data from the Service
  • Share, sell, transfer, sublicense, or commercially exploit your account credentials or subscription access
  • Use the Service to harass, stalk, threaten, defame, intimidate, or otherwise harm any individual
  • Use the Service to collect personal information about third parties for purposes of harassment, stalking, or unauthorized contact
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any software used to provide the Service
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
9. Intellectual Property

The Service, including its design, code, analytics algorithms, user interface, and documentation, is the intellectual property of CB Monitor and is protected by applicable copyright, trademark, and other intellectual property laws.

Publicly available data displayed on the Service originates from third-party platforms and belongs to the respective content creators, platforms, and users. CB Monitor claims no ownership over this third-party data.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial analytical purposes during your subscription period.

10. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

11. Third-Party Services

The Service integrates with third-party services including payment processors (PayPal, Stripe), authentication providers (Google), and data sources (Chaturbate). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices, content, or availability of third-party services.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The data or analytics provided will be accurate, complete, or reliable
  • Any defects in the Service will be corrected
  • The Service will meet your specific requirements or expectations
  • Third-party platforms will continue to make their data publicly available
13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CB MONITOR, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless CB Monitor and its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you submit or make available through the Service.

15. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:

  • Violation of these Terms or any applicable law
  • Fraudulent, abusive, or illegal activity
  • Non-payment of subscription fees
  • Extended period of inactivity
  • Request by law enforcement or government agencies
  • Discontinuation of the Service or any part thereof

Upon termination, your right to use the Service ceases immediately. Sections 9, 12, 13, 14, 16, and 17 shall survive termination.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@cbmonitor.net. If the dispute is not resolved within 30 days, either party may proceed with formal dispute resolution.

17. General Provisions
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and CB Monitor regarding the Service.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
  • Force Majeure: We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control.
